One motorist failed to navigate a roundabout after drinking ‘nine beers’, while another drove disqualified one day after sentenced in court

Mum drives from court immediately after licence suspension at court for drink driving

Motorists sentenced in Rockhampton Magistrates Court recently:

Levi Alexander Flanders, 18, had a blood-alcohol content (BAC) reading of .031 when he was intercepted driving along Lakes Creek Road, Rockhampton, on January 29 at 8.30pm.

Flanders pleaded guilty to the single drink driving charge in Rockhampton Magistrates Court on April 12.

Police prosecutor Clancy Fox said Flanders was the holder of a provisional licence with a no alcohol limit.

Mr Fox said Flanders told police he had consumed two cans of Smirnoff Double Black Vodka earlier that day.

Defence lawyer Samantha Legrady said her client was a second year apprentice at Rockhampton Auto Group and that the loss of his licence would put a strain on his employment but that he would keep his job “for the time being”.

“He is using his bicycle to go everywhere,” Ms Legrady said.

“He will not do this again.”

Flanders was fined $350 and disqualified from driving for three months.

Bradley Jack Henseleit, 23, had a BAC of .172 when he was intercepted driving on Bolsover Street, Rockhampton, at 7.34pm on March 12.

Police prosecutor Senior Constable Sarah Rowe said police were patrolling the CBD when they witnessed a vehicle driving in an erratic manner with inconsistent speeds and failed to navigate around a roundabout correctly.

She said they intercepted the vehicle on Bolsover Street for RBT and licence check.

Senior Constable Rowe said Henseleit told police he had consumed an unknown large quantity of Great Northern Beer throughout the afternoon and evening.

Defence lawyer Jess King said her client had dropped his sister off and had two beers at the pub before a situation arose where a male associate was acting inappropriately towards him.

She said Henseleit, who works as a panel beater at Beau Murphy’s Panel and Paint in Park Avenue, had run out of money and had got into the car to remove himself from the situation.

“He didn’t realise how over the limit he was,” Ms King said.

She said he thought he had about nine beers throughout the day between 10am and 7.30pm.

Magistrate Jason Schubert said Henseleit was more than three times over the limit.

“I don’t believe you only had nine beers all day,” he said.

Henseleit, who had been without a licence since the interception, was disqualified from driving for nine months and fined $1100.

Joel Marcus Lacey, 21, had marijuana in his system when he was intercepted driving an orange sedan on Boundary Road, Parkhurst, at 6.34pm on January 20.

Police prosecutor Senior Constable Sarah Rowe said this breached a 12-month good behaviour bond Lacey had been placed on for possessing drugs.

Defence lawyer Samantha Legrady said Lacey has a prescription for medicinal marijuana and accepts he can’t drive when he has that in his system.

She said he has the prescription to treat chronic and debilitating illness fibromyalgia.

Lacey was ordered to pay a $350 fine, disqualified from driving for one month and ordered to pay the bond of $1200 for breaching the good behaviour bond.

Katrina Louise Graham, 28, had methamphetamines and marijuana in her system when she was intercepted driving on Wiltshire Street, Koongal, at 9.08am on February 16.

The mother-of-three had a two-page traffic record.

Defence lawyer Rebecca Winning said her client had been under a lot of stress due to personal circumstances, including having her car stolen, and was driving to get food at the time of the intercept.

She said Graham didn’t think the drugs would still be in her system when she drove.

Graham was disqualified from driving for one month and fined $350.

Brent Nathan Jones, 34, was busted driving while disqualified by court order on Carlton Street, Kawana, about 7pm on December 7, 2021.

Police prosecutor Senior Constable Rowe said police witnessed the white ute Jones was driving turn on to Carlton Street with no headlights.

She said after he turned off Carlton Street, police found the vehicle parked at a residence in Shillam Street and watched as Jones, described as a 180cm tall bald headed male, exited the vehicle.

Senior Constable Sarah Rowe said Jones had been disqualified from driving for two months by the court the day before.

She said Jones told police he had collected the vehicle from a friend’s place.

The registration of the vehicle expired in October and it was also, therefore, uninsured.

Jones had pleaded guilty to disqualified driving, driving an unregistered vehicle and driving an uninsured vehicle.

The court heard this incident breached a Supreme Court suspended sentence for which Jones was recommitted to the supreme court to deal with the breach.

Defence lawyer Samantha Legrady said Jones had the care of his 11-month-old twins and another child, and was living with his mother-in-law after his partner left him with the children.

Jones was sentenced to a 10-month probation order and disqualified from driving for two years.
