“I’m gunna f---ing poison your dog. I’ll burn this f---ing house down”

As his uncle spoke to police, a man continued to make threats towards him,

A nephew threatened to poison his uncle’s dog and burn down his house as his uncle spoke to police about the nephew’s threat to kill him.

Joseph Albert Hall, 23, pleaded guilty on July 6 in Rockhampton Magistrates Court to one count each of threaten to damage a dwelling with intent to intimidate a person, possess a drug pipe and steal a bank card.

Police prosecutor Jennifer Leach said Hall and his uncle were at his uncle’s house in Berserker Street on July 5 when Hall started yelling at his uncle.

She said Hall walked up to the victim very close in “a stand over stance”.

Ms Leach said Hall told the victim: “I’ll burn this house down. I’m gonna kill you, you c---, you fat f---.”

She said the police arrived at 3.29pm, walked into the yard and observed Hall walk down the front stairs and stand on the front lawn.

Ms Leach said Hall immediately became belligerent and argumentative with police.

She said Hall was detained.

Ms Leach said the uncle exited the residence and sat on the top of the stairs while talking with police.

She said Hall yelled out threats directed at the uncle, including “I’m gunna f---ing poison your dog. I’ll burn this f---ing house down. No one will miss you when you are dead. You don’t deserve to be alive. I will get a gun and put a bullet through your head. I’m gunna hack him up. I’ll put wax on the stairs so he falls down them and cracks his f---ing skull open”.

Ms Leach said Hall was transported to Rockhampton watch house where he told police “words were cheap” and his uncle was a “f---ing c--t”.

She said Hall had three bags in his possession, including one large grey suitcase which contained a small red pipe in an outside compartment.

Ms Leach said that in a small black bag, police located a bank card belonging to another person.

She said Hall told police he found the bank card near the Alexander Street bridge three months ago.

Ms Leach said when police asked why he hadn’t handed the bank card in, Hall responded “I don’t give a f---”.

Defence lawyer Samantha Legrady said Hall had seen Anglicare earlier that day about relocating due to issues with his uncle.

She said Hall claimed they were “empty threats”.

Magistrate Jason Schubert placed Hall on probation for 10 months and no conviction was recorded.

“These are some serious threats,” he said.

“People are in jail for making similar threats.”
