A young teenager confronted with a drunk great grandfather about to violently sexually abuse him bravely recorded the interaction and sent it as an SOS to a family member.

The attacker, a man about 50 years older than the teen, asked the boy several sexual questions including “do you want your d**k sucked?”, “are you homosexual?” and told him to “f**k me up the ass”, Crown prosecutor Monique Bros-Wilshire told Rockhampton District Court this week.

She said these questions and comments were recorded by the boy and sent to the teen’s aunt, before the man grabbed the phone and threw it across the room.

The great grandfather, who cannot be identified for legal reasons, then touched the child’s genitalia through his shorts before pinning the victim down by his wrists and laying on top, Ms Bros-Wilshire said.

She said the attacker took off the boy’s pants and underwear, threw them on the floor and continued.

Ms Bros-Wilshire said the man abused the boy while the victim repeatedly told him to stop.

She said the offender then put his hand around the boy’s neck and the child couldn’t breathe.

“The defendant let go and the complainant said to him: ‘You’re sick c**t, I’m going’,” Ms Bros-Wilshire said.

The child then told his great grandmother what had happened.

Ms Bros-Wilshire said when the boy’s aunt arrived, she and the boy used violence against the offender.

She said the boy dropped his phone and the attacker picked it up and snapped it on the staircase.

Ms Bros-Wilshire said the boy’s father and another man then arrived and pushed the attacker off a bike and when he did not get back up they called an ambulance where he was taken to hospital and later arrested.

She said he told police he was “drunk and silly” and then gave a version of events that was not accepted by the Crown.

Defence barrister Jordan Ahlstrand said his client had no explanation for the offending, other than being intoxicated.

The court heard he had abused alcohol since he was a teenager.

The man pleaded guilty to two counts of indecent treatment of a child under 16, one of attempted indecent treatment of a child under 16 and one of wilful damage.

He was sentenced to 2.5 years prison with 274 days presentence custody declared as time already served.

The sentence was suspended after having served 274 days with a four-year operational period.
