The bizarre reason behind a home invasion has been revealed as a former house painter has been jailed over the infiltration.
Damon Noel James Hudson, 29, and three other men broke into a stranger’s house in Allenstown in the early hours of the morning in September, 2024 after demanding a man exit the residence, Rockhampton District Court heard on March 26.
Crown prosecutor Monique Bros-Wilshire said the victim returned home with friends after being out for the night when he heard whistling and immediately locked the doors.
She said soon after, Hudson and his accomplices were outside the house calling out for a ‘Joshua’ to come out of the victim’s house.
Ms Bros-Wilshire said when there was no answer to this demand, the men outside entered the front yard and verandah area.
“The victim and her friends have hidden in her bedroom and locked the door with the lights off,” she said.
Hudson covered his face with his shirt and was armed with a wooden fence paling as he stood at the front door continually making threats towards ‘Joshua’ such as “I’m going to run through your house and f**k your mother unless you come out and fight like a f**king man”.
One of his accomplices was armed with poly pipe which was used to smash a window while Hudson used his body and fence paling to force entry into the house via the front door, damaging the locking mechanism.
Hudson entered the house and was in there a short time before leaving – all captured on camera.
He was arrested by police a short time later – at 4.03am – at the Saleyards.
The court heard Hudson had been outside at the Zodiac nightclub earlier that evening with the mother of his children, Sabrina Maree Elliott.
Ms Bros-Wilshire said this was a case of mistaken identity or understanding of who lived in that house and this occurred after an incident earlier in the evening at a nightclub which was drug-related.
Defence barrister Jordan Ahlstrand said there had been an altercation earlier that night outside the Zodiac nightclub between his client, the mother of his client’s children and another group of people where the young mother was hit.
He said the other group walked away from the nightclub while Hudson went on to drink more alcohol.
“He foolishly, in his intoxicated state, thought it would be appropriate to go and challenge that person to a fight, and in doing so, he’s turned up to the wrong address,” Mr Ahlstrand said.
“He appreciates that it would have been a frightening experience (for the victim).”
Mr Ahlstrand said Hudson, a father of two, has worked as landscaper, tree lopper and house painter.
The court heard Hudson was jailed in May 2022 for possessing more than 500g of drugs on three occasions – one of those being stashed for Ms Elliot’s trafficking business.
Ms Elliot was sentenced in November 2021 after pleading guilty to one count of trafficking a dangerous drug, one of possessing a dangerous drug in excess of 500g, three possessions of a dangerous drug and 13 summary offences including a wilful damage.
She received a three-year prison term with 246 days presentence custody declared as time served and immediate release on parole.
Hudson received a nine-month prison term in May 2022 with 207 days presentence custody declared as time served and immediate parole release.
Hudson was also sentenced that year in February for an assault occasioning bodily harm for which he received a nine-month prison term, suspended for two years.
Hudson pleaded guilty on March 26, 2025, to one count of burglary with break in the night while armed in company and one of wilful damage.
He was sentenced to two years prison with 192 days declared as time already served and immediate parole release.
