A convicted child sex offender with anger management issues pulled a knife on motel staff has repeatedly failed to comply with his reporting obligations.

Samuel Jacob Bryon Stubbs, 21, pleaded guilty on April 14 in Rockhampton Magistrates Court to one count of going armed in public to cause fear, wilful damage, obstruct police and three counts of failing to comply with reporting requirements under the Child Protection Act.

Police prosecutor Brandy Butler said police were called to the Rusty’s Motel in Goondoon Street, Gladstone, on January 25 about 3pm with reports of a male threatening staff with a knife.

She said police located Stubbs in one of the rooms.

Ms Butler said police spoke with management and the victim who claimed Stubbs and his father had been arguing throughout the day and slamming doors.

She said the victim told Stubbs to stop slamming doors and to be quiet, however, Stubbs continued.

Ms Butler said the victim told Stubbs and his father to pack up and leave the premises.

She said Stubbs exited the motel room holding a folding knife with a 12cm blade and walked towards the victim who was standing about 15 metres away.

“He pointed the opened knife towards the victim and said the words to the effect of ‘you want some of me? You want to try me? I’ll stab you all’,” Ms Butler said.

She said the victim reported there were two other guests outside their rooms when this occurred, with Stubbs pointing the knife at the guests after the motel staff member.

Ms Butler said Stubbs’s father then ushered the young man back inside the room.

She said Stubbs told police he was on medication which caused him to have serious anger management issues.

During his arrest, Stubbs “violently resist being handcuffed” by pulling his arms to his sides, thrashing them about, grabbing at the handcuffs and clenching his fists up to his chest.

He also spat on one of the officer’s sunglasses which were placed on a parked vehicle.

Stubbs failed to comply with reporting requirements under the Child Protection Act three times since November 2021, having been convicted in February 2021 for indecent treatment of a child under 12.

One on occasion, Stubbs told police he “did not believe the system was fair” and on another occasion, told police he had been evicted and knew he had to report his change of address but forgot.

These occasions were not the first time Stubbs had failed to report as he had three convictions from September 2021 for the same offence and was recommitted to the district court for breaching a suspended sentence.

Ms Butler submitted Stubbs had “a complete lack of regard for that order”.

Defence lawyer Jun Pepito said his client had been diagnosed in 2017 with a brain tumour.

He said his father was his carer and his father was recently made carer of his own mother who has fallen ill.

Mr Pepito said Stubbs needs help regulating his emotions.

Magistrate Philippa Beckinsale said the medical evidence before the court showed Stubbs suffered from neurological problems.

“There is a clear mass on the brain,” she said.

“Evidence of recent haemorrhage and increased signal in the temporal lobe consistent with recent seizures.”

She warned Stubbs the more he continued committing offences, the less these medical factors will be taken into consideration during sentencing.

Ms Beckinsale placed Stubbs on a two-year probation order and recommitted him to the district court for breaching the suspended sentence again.
