Brendan John Graham threw a nurse’s mobile phone at her while he was receiving treatment at Biloela Hospital

‘Out of character’: A Biloela man receiving treatment at hospital yelled and swore at staff who felt threatened by his behaviour - they made an urgent call to police.

A man receiving treatment at Biloela Hospital picked up a nurse’s mobile phone from a desk and threw it at her.

Brendan John Graham, 21, pleaded guilty in Biloela Magistrates Court on October 13 to one count of public nuisance.

That charge stemmed from an incident on September 24, at 7.15pm, where Biloela police received a call about an intoxicated person walking a bike along Gladstone Road.

Police found that person, Graham, a short time later - he was laying on top of his bike, on the footpath.

Graham was “grossly intoxicated”, slurring his speech and could not stand without stumbling.

He had a cut on his shin and abrasions on a leg, and was taken to Biloela Hospital for treatment.

About 8.15pm, police received an urgent call from the hospital.

A staff member advised that Graham was causing a disturbance, yelling and swearing at staff, and not complying with their requests.

Police attended the hospital and Graham continued swearing.

He left the hospital after being picked up by his mother.

Police then spoke to staff who said Graham had picked up a nurse’s mobile phone from a desk and threw it at her.

He was verbally aggressive and swearing at the time and staff felt threatened by his behaviour.

The court was told that Graham had no criminal history and no traffic history.

Graham’s solicitor said Graham was a Woolworths worker who had no recollection of anything that happened on the day of his offending.

The solicitor said Graham had gone to the bowls club in the afternoon with $30 and had “maybe five schooners of beer”.

“Whether an assumption can be drawn, was his drink spiked?” the solicitor said.

“We don’t know, we’ve got no evidence, we’ve got no way to prove it, but it’s totally out of character for this young lad.”

Magistrate Philippa Beckinsale accepted the submission that this was out of character for Graham and placed him on a good behaviour order for six months with a $500 recognisance.
