Two delinquents fined for ‘naughty’ Christmas Eve outside Mackay nightclubs

Two North Qld men made a last minute switch on Santa’s naughty or nice list and were told to ‘grow up’ after they got into mischief uptown.

When the big man in red was doing a last minute check of the naughty or nice list, two names in particular had switched sides.

Xian James Mallie, 25, and Elisha Boaz Mark Potter, 24, got into mischief uptown on December 24 and had to face the consequences before the Mackay Magistrates Court.

Magistrate Damien Dwyer said the Mackay men “took a real risk being naughty on Christmas Eve”.

Police prosecutor Leonie Taufa’ao said police officers witnessed Mallie arguing with and shouting at two women while waiting to enter The Gallery on Wood St.

“Two male persons next to (Mallie) were physically restraining him from approaching,” Ms Taufa’ao said.

“Police attempted to separate (them and) witnessed (Mallie) reach out and shove one of the female persons who he’d been yelling at.

“ (Mallie) shouted, ‘Oi grab them three c**ts’ (and) ‘I don’t give a f**k’.”

Defence lawyer Phillip Moore said Mallie, who works in Paget and has a minimal criminal history, “was not proud of his behaviour” and the women had pushed into line.

Mr Dwyer banned Mallie from the Mackay Safe Night Precinct for three months, fined him $500, and told him it was “time to grow up”.

A conviction was not recorded.

Potter was also banned from the precinct “in relation to another matter” on Christmas Eve.

Ms Taufa’ao said police issued Potter with the ban which would begin at 12.30am on December 25 and end on January 20.

“At approximately 2.05am (on December 25), (Potter) was observed walking along Victoria St outside the Rabbit Hole nightclub.”

The court heard Potter, who had a “history of street offences” could not explain why he had ignored the police ban and was arrested and taken to the watchhouse.

The hydraulic hose technician was fined $500 and a conviction was recorded.
