A young mother who “encouraged” her friend to violently assault a teen including slashing her with a box cutter during a home invasion will not have to spend any more time in jail for her role.
Tiahrnie Jade Davis, 26, had been at the Sophie St complex as heavily pregnant Shae-Lee Finney first confronted her 19-year-old victim over allegations the teen had slept with her partner.
The attack included Finney grabbing her by the throat with both hands and squeezing, stomping on her while she was on the ground and slicing her on the arm and leg with a box cutter.
Finney pleaded guilty to burglary in the night while armed and two counts each of wounding and common assault over the 3am assault and was jailed for four years with parole eligibility in July 2024.
Mackay District Court heard heard the pair had travelled together in the same car but Davis, then 25, had not been involved in the home invasion or box cutter attack.
Davis had been charged because her “presence at the scene was an active encouragement for the commission of the offence”, the court heard.
Barrister Paul Rutledge, for Davis, said his client had become involved with a man in the drug scene and started using meth, but stopped using the drug during her pregnancy.
“She also appears to be a good mother,” Mr Rutledge said.
Davis pleaded guilty to burglary at night and two counts of assault on July 5, 2023 - following her arrest the next day she spent almost eight months in custody on remand.
Judge Vicki Loury accepted Davis remained outside the courtyard fence near the car while Finney attacked and assaulted the victim.
“You do have a considerable criminal history for predominantly drug offending,” Judge Loury said, adding the last offence was in January 2021 coinciding with her pregnancy.
“Because you’ve served such a significant period in custody - I will impose a sentence that takes that into account.”
Davis was jailed for 18 months, immediately suspended after time already served.
