Mackay’s Tamlin Francis Fitzpatrick-Giles charged with rape and torture against 17-year-old girl

Lawyers for a Queensland man charged over an alleged horror sex act involving BDSM have asked for the matter to be pushed forward. DETAILS 

Police allege 26-year-old Tamlin Francis Fitzpatrick-Giles committed acts of rape and torture against a 17-year-old in Mackay sometime between November and December 2023.

The matters against a Mackay man accused of a horror sex act involving BDSM have been delayed as the case progresses through the court.

Accused torture rapist Tamlin Francis Fitzpatrick-Giles had his matters mentioned in Mackay Magistrates Court on Wednesday when his lawyer Marcus Hahn, of McKay’s Solicitors, asked for an adjournment.

He is currently on bail after he was granted a conditional release by the Supreme Court in mid February.

Police allege 26-year-old Mr Fitzpatrick-Giles committed acts of rape and torture against a 17-year-old in Mackay sometime between November and December 2023.

It is further alleged the offending involved a BDSM (Bondage, Dominance, Submission, Sadomasochism) act gone wrong.

Anyone convicted of rape faces the possibility of life imprisonment, while torture carries a maximum penalty of 14 years jail if convicted.

Mr Fitzpatrick-Giles’s appearance was excused.

Mr Hahn said barrister Scott McLennan had been briefed on the case and he requested an extension of time, to which Magistrate Bronwyn Hartigan agreed.

In September 2023 new laws were passed allowing those charged with prescribed sex offences such as rape to be named while the matters were still in the Magistrates Court.

Previously offenders facing these charges could only be named once a case had been committed to the district court, sometimes months or more than a year into the court process, and only then if it would not identify any complainant.

The case will return to court later this month.
