A man accused of running down rugby league legend and former origin great Martin Bella has had his charges upgraded in court.
Samuel Anthony Camilleri was alleged to have driven his ute at Mr Bella, who was on a quad bike, on July 15 at a property at Koumala.
It is alleged this occurred when Mr Bella, a councillor with Mackay Regional Council, came across Mr Camilleri on a newly bought property 60km south of Mackay.
Police had been further alleged Mr Camilleri then sprayed a substance in Mr Bella’s eyes several times before further assaulting him.
Mackay Magistrates Court on Wednesday heard that charge was dismissed with prosecution offering no evidence.
Magistrate Bronwyn Hartigan said instead the new charge was assault occasioning bodily harm while armed with a dangerous instrument.
Mr Camilleri, presenting to court with his left arm in a sling, did not enter a plea.
Defence lawyer Antoinette Morton, of Fisher Dore Lawyers, said they were still waiting on a “substantial amount” of outstanding material from the prosecution.
This included two sets of body-worn footage, a statement, two pieces of information identified in an affidavit, analytic service unit results and a statement made to a police officer.
Prosecutor David Epstein said the unit results would not be available until the end of the year.
Ms Hartigan agreed to an adjournment and granted Mr Camilleri a new bail agreement.
His appearance is excused at the next mention with a hearing date previously listed for late December.
