A popular nightclub’s owners have been charged with having an unsafe premises and making illegal promotions.
Senior compliance officer Shelley Hancock represented the Office of Liquor and Gaming Regulation in prosecuting the two charges against Mackay CBD Hotel Pty Ltd.
The company owns the popular Rabbit Hole party bar at 105 Victoria St, as well as the now closed Movida’s Hotspot and Dirty Martini’s Lounge.
Mackay Magistrates Court heard pleas could not be taken by consultant David Chaffey, requiring an officer of the company to respond to the charges.
Mackay CBD Hotel director Andrew Darveniza appeared by phone call, pleading not guilty to failing to maintain a safe environment in and around the premises and engaging in unacceptable practices or promotions on June 23, 2023.
When asked by Magistrate Damien Dwyer how long a hearing would take, Ms Hancock estimated a day trial would be suitable.
The court heard a brief of evidence ordered to be made available by the prosecution for the defendant by July 12.
The matter was adjourned to September 10 for hearing.
