A Whitsunday mum turned drug pusher has avoided going back to jail, but has been warned she is on her last chance.
Police downloaded information from Lisa Renae Wayne’s phone that revealed she had four customers who she had supplied drugs to 16 times.
Mackay District Court heard 13 of the supplies involved marijuana, while three involved an unknown schedule one drug including one for 43 grams.
The court heard most of the marijuana supplies were in $50 quantities, but there was one totalling just more than $300.
Wayne, 26, pleaded guilty to 16 counts of supplying a dangerous drug at Proserpine between June 3 and July 15, 2020 – her offending was on the basis there was a commercial element to all her supplies.
She was arrested on July 21, 2020 but failed to appear in Proserpine Magistrates Court in early January 2021.
She was remanded in custody in October 2021 and spent 63 days behind bars until she was released after pleading guilty in Bowen Magistrates Court to other offending that occurred around the same time as the drug supplies.
The court heard she had been held on remand for both series of offending.
Barrister Matt Heelan, instructed by PD Law, said his client had not been avoiding police and assumed she would be arrested for failing to appear.
“She was not necessarily hiding from police … just neglecting her obligations,” Mr Heelan said.
The court heard Wayne had previously been released on parole on other offences and received a scathing report deeming her unsuitable for further community based orders.
Wayne had since moved to Collinsville to live with her mum and grandmother and had a job lined up.
The court heard she had also stopped using drugs and was making efforts towards her rehabilitation.
Judge Brad Farr said the question was whether or not Wayne would spend any more time behind bars but ultimately decided to give her one more shot on parole.
“This is your last chance,” Judge Farr said.
Wayne was jailed for 12 months with immediate release on parole.
Judge Farr also declared the 63 days she spent on remand as time already served. Convictions were recorded.
