A ‘scathing’ report describes a man’s ‘pro-criminal sentiments’ and his rejection of authority and social norms as the reason behind his shocking behaviour.

An anti-authoritarian with pro-criminal sentiments who used cocaine at a baby naming ceremony and engaged in street fighting has been told he is on a “slippery slope to nowhere”.

Dylan Abraham Allan Milner pleaded guilty in Mackay Magistrates Court on May 6 to a number of charges including public nuisance and obstruct police.

Magistrate Damien Dwyer told Milner to re-engage with probation authorities after reading a “damning report about his “atrocious” response to a probation order he was completing.

When Milner reappeared at court on Thursday, Mr Dwyer heard he had returned to his probation appointments but queried why now.

“Why did you go back Mr Milner – because you’re scared of going to jail?,” he asked.

“I would definitely prefer not to go to jail,” Mr Milner said.

“We would prefer you obey the law,” Mr Dwyer quipped back.

Mr Dwyer said the “scathing” report from the Corrections Department about a previous probation order described his attendance as sporadic because he was “busy and not able to remember his appointments”.

He said Milner had “provided dismissive responses when reminded of his obligations”.

“Mr Milner’s offending behaviours are linked to significant pro-criminal attitudes,” he said, reading from the report.

“He continues to present with a rejection of authority and social norms.

“Illicit substance abuse offer additional areas of risk.

“He had a relapse prevention plan but he lapsed using cocaine at a baby naming ceremony.

“He has said “you can stick it, I will do what I like, I will keep taking cocaine, I will keep taking cannabis’ … pro-criminal sentiments.

“Everybody has a choice of what they want to do and everybody has a consequence of what they do, some good, some bad.

“You are just a baby Mr Milner.

“We’re not here to pussy you around, I’ll give you the drum.

“I’m not offering probation again, he’s had his chance.”

When Mr Dwyer asked a corrections officer why the earlier January report had not been revised, she said Milner’s attendance had been superficial, only engaging since May 6 because of the upcoming sentence.

When asked for a response on why the Corrections Department’s report was so “scathing”, solicitor Grace Sharma said her client did not feel comfortable talking to the corrections officer.

“My instructions are that there has been a breakdown in relationship between Mr Milner and the probation office,” she said.

Ms Sharma said her client had engaged with alcohol and drug abuse services, attended a psychologist appointment, was on a care plan and was now out of a “toxic relationship”.

“He was in a toxic relationship that relates to one of the charges, which has now ended,” she said.

Mr Dwyer shook off the toxic relationship submission.

“If you’re in a toxic relationship and you need assistance you go and talk to someone about it, you don’t go to baby naming ceremonies and take cocaine,” he said.

“What about fighting in the street? His partner’s fault, his probation officers’ fault, his school teacher? So far it’s everybody else’s fault except for Mr Milner.”

Almost ironically wearing a T-shirt with the phrase “If Milner can’t fix it, no one can”, he was told to look in a mirror when he got home.

“That’s where you’ll find the problem,” Mr Dwyer told Milner.

“The problem is not your partner, not me, the problem is not the probation officer, the problem is you and your attitude.

“You are firmly, in my view, on a slippery slope down to nowhere.

“If you want to persist with this attitude, and I see it still here today, you are going to go to prison, it’s as simple as that.

“You’re the one fighting in the street, you’re the one taking cocaine, you’re taking marijuana, you’re the one sending filthy messages off to an ex partner, and you’re the one not completing your obligations to this community through your probation office order.

“And when you were told not to drive, you said ‘I’ll drive whenever I want’.

“You are firmly on the way to prison Mr Milner. No one is going to change that but you.”

Miner must pay a $3000 fine and complete 40 hours of community service.

An earlier probation order has been revoked.

Convictions are recorded.
