Brendan Patrick Zamparutti sentenced for obstructing police while intoxicated after Gallery approach on officers

A drunk man’s request for police to touch his bum ended with him in handcuffs after he was arrested for obstructing officers during a night out with mates.

A Mackay man’s flirtatious attempt with a police officer ended in unkinky handcuffs outside a popular CBD nightclub.

Brendan Patrick Zamparutti was arrested for obstructing police while intoxicated after he saw his friend speaking with an officer.

The 20 year old was in the line outside Gallery Bar and Lounge when he saw police sitting on a park bench with a drunk friend.

Police prosecutor Harry Coburn told Mackay Magistrates Court Zamparutti approached police to ask what was happening.

He got within 30cm of the officers, and was asked to step back.

Zamparutti complied, but shortly afterwards he approached again, asking police “can I just, sort of understand where you’re coming from?”.

Mr Coburn said police told Zamparutti he was obstructing them and he needed to step back to avoid arrest, to which he complied again.

Shortly after, he returned to standing within 30cm of the officers, recording the scene on his mobile phone with the flashlight on.

Mr Coburn said Zamparutti attempted to grab onto the officer, and he was arrested and restrained for obstructing police.

As he was being arrested, Zamparutti told the officers “if you want my a---hole I’ll give it to you”, and “can you like, touch my bum?”

When police asked for Zamparutti’s name, he told them “my name is Michaelangelo”.

After being taken to the Mackay watch-house, Zamparutti returned a 0.186 blood alcohol concentration.

Zamparruti pleaded guilty on January 5 to obstructing police while adversely affected.

He told the court his friends had enjoyed an afternoon barbecue, before making an impromptu decision to go out in Mackay’s CBD.

Zamparutti agreed his behaviour was unacceptable and he was remorseful for his actions.

He said he should have “minded his own business”.

Mackay Magistrate Damien Dwyer said Zamparruti needed to “grow up”.

“Police have a hard enough job to do without mugs like you getting involved,” he said.

“You went a little bit too far.

“If you can’t handle your grog, get off it.”

Zamparutti was instructed to complete 40 hours of community service within three months.

He was also banned from entering in any licensed premises in the Mackay safe night precinct for two months.

A conviction was not recorded.
