Mark William Pendleton pleads guilty to public nuisance after telling hospital staff to ‘get f---ed’

A drunk Mackay man carrying a speargun told hospital staff to “f--- off” and called them c--ts after trying to collect personal possessions.

A drunk man wielding a speargun turned aggressive after trying to retrieve some personal possessions from hospital.

Mark William Pendleton, 55, faced court on public nuisance charges after he became abusive at Mackay Base Hospital on December 6 last year.

Police were called to the hospital after Pendleton entered the mental health unit at the hospital with an unloaded speargun and became aggressive with security at 8.15pm.

Police prosecutor Rob Beamish told Mackay Magistrates Court the Mackay Harbour man was asked to leave the speargun outside the hospital and he complied.

However, when security approached him he told them to “f--- off”, and began calling them “c--ts”.

Pendleton, who was under the influence of alcohol at the time, was arrested for public nuisance.

He was ordered to face court on January 5, but he did not show and a warrant was put out for his arrest.

When he did face court on January 6, Pendleton told Magistrate Damien Dwyer he had a bad memory.

“I’ve got a bad memory, I’ve got short-term memory loss,” he said.

“I came about 12.30pm or so, and you were all on lunch.”

Pendleton disputed Mr Beamish’s version of events, and said he was told Queensland Police had his possessions when he arrived at the hospital.

“I went inside to get my possessions, and security told me QPS had my possessions,” he said.

“I asked one of the chaps if they could ring them for me, I wasn’t violent.”

Mr Dwyer said Pendleton had not been arrested for being violent.

“You’re not charged with being violent, you’re charged with being a pest,” he said.

“I’m not worried about the speargun, I’m more worried about you telling them to ‘get f---ed’.

“You don’t do it by going around telling people that work in the hospital what you did tell them.

“I look at your history, it’s chock-full of grog-related matters but you don’t have other public nuisances.”

Pendleton pleaded guilty to public nuisance, and was fined $400.

A conviction was recorded.
