Curra abuser charged with DVO breach released on parole

A 38-year-old Curra man behind bars for domestic violence offences, was targeted by the other prisoners, who slid faeces under his cell door and smeared it on his clothes.

A 38-year-old Curra man who chased his partner with a tyre iron while threatening to attack her has been released on parole after spending two months in protective custody.

The man, who cannot be named for legal reasons, appeared in Gympie Magistrates Court via video from pre-sentence custody on Wednesday.

He faced 12 charges from May 2020 to May 2021, including breaching a DVO twice.

He was also charged with stealing, drug possession, breaching bail, driving an unregistered vehicle and failing to appear.

The 38-year-old pleaded guilty to all charges.

Police prosecutor Michael Phillips told the court the first time the man breached the DVO, he began an argument with his partner after she declined to sleep with him.

The second time, he tried to throw her from the car and chased her with a tyre iron, threatening to bash her with it.

Sgt Phillips said the man stayed in contact with the victim and had “no regard for the order”.

Defence lawyer Chris Anderson said his client has been relentlessly harassed while in pre-sentence custody.

He said his client has had his food tampered with and faeces slid under his cell door and smeared on his clothes.

As a result, he was moved into protective custody after one month in pre-sentence custody.

Magistrate Chris Callaghan described the man’s crimes as “serious offences”, and called his violent behaviour towards the victim “outrageous”.

Despite this, Mr Callaghan ordered the man be released on parole immediately.

“Thank you your honour,” the man said.

He could be seen sobbing with his head in his hands after the news was delivered.

He was sentenced to eight months behind bars, with immediate release.
