A Gladstone man armed with a plank of wood broke into a north Brisbane man’s backyard with an alleged accomplice and brutally assaulted him.

Kaid Heath Millers, 20, pleaded guilty on Friday to three charges including assault occasioning bodily harm while armed, stealing and contravening direction or requirement.

Police prosecutor Merrilyn Hoskins told the court that on April 16, around 6pm, the 64-year-old male victim saw two men in the rear yard of the vacant home behind his Clayfield address.

One of the defendant’s yelled out “I’m looking for my cat” before they left the yard, but returned 10 minutes later yelling threats and abuse at the victim.

The abuse carried on for around 20 minutes, before the victim moved into his backyard to further observe the defendants in case they caused damage or attempted to enter his yard.

The defendants began shining a torch light at the victim, before breaking through the victim’s fence and entering his backyard.

Millers was armed with a length of wood that he used to strike the victim to his head and body, which caused the victim injuries including a scalp laceration which required sutures.

The victim was able to disarm Millers and used the length of wood to defend himself, which forced the two men to leave his property.

Around 8.30pm police located Millers and the other man who appeared grossly intoxicated and had small lacerations over their bodies related to physical conflict.

Millers and his alleged accomplice were arrested, with Millers stating he had assaulted the victim because he or his brother had removed part of a fence from the neighbouring vacant property.

Ms Hoskins said Millers’ conduct was serious and, despite the victim’s injuries being described as ‘not serious in nature’, actual jail time was not out of range.

Millers’ solicitor Jun Pepito said Millers should be spared a heavy penalty, including actual jail time, given his young age and lack of similar offending.

Magistrate Bevan Manthey convicted and sentenced Millers to 12 months imprisonment, with a parole release date set at February 6, 2022. Convictions were recorded.
