Central Qld man refused bail after alleged strangulation

A man who allegedly strangled a Central Queensland woman in a domestic violence incident has made a bid to get out of custody before Christmas.

A man who allegedly strangled a Central Queensland woman in a domestic violence incident has made a bid for freedom before Christmas.

Nicholas Donald Mboge, 54, appeared in custody in Gladstone Magistrates Court where he made a bail application.

He is facing a charge of choking/suffocation/strangulation (domestic violence offence).

The court heard Mr Mboge was in a show cause situation and the prosecution opposed bail.

The court was told Mr Mboge had allegedly strangled a woman to the point where she had defecated.

Solicitor Stephen White said the alleged victim had now moved from the residence where the alleged offence happened and she was living with a family member.

Mr White said Mr Mboge was not suffering from any drug or alcohol addictions.

He submitted any potential risk to the alleged victim could be adequately mitigated by bail conditions including reporting to police no less than three times per week, and a prohibition on approaching the alleged victim.

“Noting... the alleged victim does spend large amounts of time, a considerable distance from Gladstone working,” Mr White said.

“And has relocated herself (to live with the family member).”

The court heard Mr Mboge had a two-page criminal history which Mr White submitted was “dated in regards to like offending.”

Police prosecutor Sergeant Kevin Ongheen said the interpretation Mr Mboge’s criminal history contained “dated” offences “is one interpretation.”

“Another is, that when he does lose control of his anger and lashes out, it is with dire consequences,” Sgt Ongheen said.

“And it might happen only intermittently, but it does happen.”

Sgt Ongheen then referenced Mr Mboge’s numerous previous assault occasioning bodily harm convictions.

In relation to the current charge before the court, Sgt Ongheen said the allegations were “extremely serious”.

“Where he has (allegedly) committed the act of strangulation to the extent that the (alleged) victim has defecated,” Sgt Ongheen said.

Sgt Ongheen said Mr Mboge had allegedly been drinking alcohol at the time of the alleged offence.

“That is a factor,” he said.

Sgt Ongheen said the alleged victim was “very fearful” of Mr Mboge.

Magistrate Mary Buchanan was not satisfied Mr Mboge had shown cause and she refused bail.

Mr Mboge was remanded in custody with his matter adjourned to February.
