Zachariach Simshauser in Gladstone court for dealing drugs

A man who threatened to bash and kill a Central Queensland carwash owner during an ugly confrontation was also busted dealing drugs.

A man who threatened to bash and kill a Central Queensland carwash owner during an ugly confrontation at the business, has faced court.

Zachariach Richard Simshauser, 33, pleaded guilty in Gladstone Magistrates Court to charges including supplying dangerous drugs, drug driving, possessing drug utensils, public nuisance, receiving and possessing tainted property, possessing suspected stolen property and possessing a knife in public.

Simshauser’s offending was detailed in a 16-page sentencing schedule tendered to the court.

The court heard a summary of that offending which started in July last year when Simshauser was caught drug driving.

Then on separate dates in September he committed the public nuisance and receiving tainted property offences.

The public nuisance involved Simshauser being at a carwash at Tannum Sands.

The owner of that business approached him and told him he was banned from the carwash due to a previous incident.

The court heard an “enraged” Simshauser got out of his car, stepped towards the owner and when just centimetres from his face, yelled and swore at him, saying “I’ll knock you out and put you in a box.”

The owner stepped back, but Simshauser continued to yell and swear at him, saying “F*** you... I’ll bash you and I’ll kill you.”

On October 4, he was caught with a knife in public, as well as drug utensils and tainted property.

Later that month, he was busted supplying cannabis.

In January this year, police caught Simshauser with suspected stolen property.

Simshauser had a two-page criminal history which included dishonesty and drug offending, and a four-page traffic record.

Solicitor Bianca Wieland said Simshauser, born and raised in Gladstone, was currently working as a carer and he had not been in court since 2021.

She said Simshauser suffered from autism, ADHD and anxiety, and at the time of the offending he was struggling with homelessness and using methamphetamine.

“He has now been clean from that substance for several months,” Ms Wieland said.

Magistrate Mary Buchanan placed Simshauser on 18 months’ probation with conditions.

She also fined him $400 and disqualified him from driving for three months.

Convictions were recorded.
