Teen girl’s murder case for Stewart Wallace-Cuneo death delayed in Hervey Bay

Key witness details and what needs to happen before an upcoming hearing into the high-profile alleged murder of a 24-year-old man at a Qld caravan park can be revealed.

The case against a teenager charged with murdering a man at the Big4 Pt Vernon Caravan Park last year has been delayed in court once again as important paperwork is still not ready.

The teen girl, who cannot be named and was 14 at the time of the incident, was charged with murder after allegedly stabbing 24-year-old Stewart Wallace-Cuneo in the back at the BIG4 Holiday Park.

Police will allege the two had known each other for only a matter of hours beforehand and that the teen and another girl had been left without supervision and in possession of alcohol and drugs.

A directions hearing was set to be held on Tuesday, July 29 at the Hervey Bay Magistrates Court, but will be delayed by one week due to written submissions not being ready after they were only submitted on Tuesday morning.

Additionally, a formal directions hearing application was not submitted until Monday, July 28, making it unrealistic for legal professionals involved to read all the submitted material, the court heard.

Many witnesses are set to be called to the matter, including a pathologist, one juvenile witness, 13 civilian witnesses, and the mother of the defendant although her cross-examination has been rejected by the prosecution.

A toxicology report is another piece of evidence causing delays due to issues in the Brisbane laboratories where it is being prepared.

The case was adjourned to Wednesday, August 6 by Magistrate Trinity McGarvie.

The teenager’s appearance was excused for next week’s hearing.
