A man with a background as a security guard in regional Queensland has pleaded for no conviction to be recorded after he punched another man while drunk at a takeaway restaurant.

Bradley Louis Britcher appeared in Dalby Magistrates Court on December 12 after he assaulted a man who was unknown to him at the time, while inside McDonald’s during a terrifying brawl that involved a number of people inside the restaurant.

Police prosecutor Derek Brady said at 2.30am on September 3 the 28-year-old Dalby man, along with his cousin and a group of friends were taunting staff members of the food chain.

“(They) were belittling and calling staff members names, and a member of the public overheard the disrespectful language and had words with Britcher,” Sergeant Brady said.

The court was told Britcher said, “what are you going to do about it?”

The victim replied “f--k off and leave”.

“In an attempt to move away, (the victim) put his hands on Britcher’s chest to push him away,” Sergeant Brady said.

“Britcher punched the victim in the side of his face.”

The court was told when police reviewed the CCTV footage later, they described the scene as Britcher punching the victim in a “king hitting motion”.

The victim fell to the ground after being punched, with his head split open and had to be transported to Dalby Hospital according to the police report.

“Britcher punched and fought other members of the public before he fled the McDonald’s,” Sergeant Brady said.

Defence lawyer Paige Hetherington said her client, who is also a father of three, had obtained a security licence five years ago however had his licence suspended six weeks prior due to the offences.

She told the court that the man had been drinking for 10 hours that day, celebrating his cousin’s birthday.

“He was very intoxicated by that time,” she said.

“He believed the complainant was trying to initiate a fight when he put his hands on his chest, and he’s extremely remorseful.”

Ms Hetherington asked that no conviction be recorded as it would be “detrimental” to him having his security licence reinstated.

Acting magistrate Andrew Walker acknowledged the character references submitted on the man’s behalf, along with an apology letter he wrote expressing his deep remorse.

Britcher pleaded guilty to affray and assault occasioning bodily harm.

He was ordered to complete 100 hours of community service in nine months, and ordered to pay $1500 to the victim in compensation.

No conviction was recorded.
