Drink or drug drivers who faced Dalby Magistrates Court

From a drug driver found in possession of a knife to a drink driver who crashed avoiding a kangaroo, these are four people who faced court on Tuesday.

These four people faced Dalby Magistrates Court on Tuesday for either drink driving or drug driving.

NO CONVICTION

Terrence William Burn

The 76-year-old pleaded guilty to drink driving after police detected him drink driving on May 2 in Dalby.

Burn was subject to a RBT on Cunningham Street where he recorded a reading of 0.069.

In sentencing, Magistrate Kathleen Payne took into account that Burn had no prior traffic or criminal offences and said it was “remarkable” he had made it to 76 with no blemishes.

He was issued a $350 fine, a one month loss of license and no conviction was recorded.

William John Hamua Paaki Marsh

The 33-year-old also pleaded guilty to drink driving after police pulled over his vehicle in Dalby on June 9.

Paaki Marsh had an alcohol reading of 0.148.

Magistrate Payne said the offending for Paaki Marsh, who had no prior convictions, was “out of character”.

He was fined $500 and had his licence suspended for four months.

No conviction was recorded.

Mitchell Glen Anderson

Anderson, 38, also pleaded guilty to drug driving and possessing a knife.

At 4.45am on May 2 police subjected Anderson to a RBT where he blew positive for methamphetamine and THC.

A search of Anderson’s vehicle also revealed a large hunting knife improperly stowed and within arms reach beneath his car seat.

Anderson was cooperative with police and told them he had been hunting the week prior, which is why the knife was in his car.

Anderson also had no prior criminal history and the offending was “out of character”.

He was hit with a $450 fine, a three-month licence suspension and was required to surrender the knife.

No conviction was recorded.

Mark Paul Ferguson

The 35-year-old pleaded guilty to driving while under the influence.

The court heard on May 6, police were called to the scene of a single vehicle crash on Timothy Road at Tara.

When they arrived they found Ferguson in his vehicle, where they issued him a breath test.

It returned a reading of 0.145.

Ferguson told police he had swerved to avoid a kangaroo.

Ferguson‘s licence was suspended for three months, and had was handed nine-month probation period.

No conviction was recorded.
