An aged care worker charged for her involvement in a large street brawl outside a Central Queensland pub was involved in a separate fight at the same venue weeks earlier, it has been revealed in court.

Nioka Jade Carrie-Anne Ross, 25, pleaded guilty in Emerald Magistrates Court to two counts of public nuisance over the two altercations.

The court on November 15 heard Ross was one of 30 people involved in the brawl that took place outside The Irish Village pub in Emerald starting on Saturday, August 7 and continuing into the early hours of Sunday, August 8.

A verbal altercation that began outside of the venue between a handful of people spiralled out of control into a moving and chaotic street fight that ended at the corner of Egerton and Anakie Streets.

Ten calls from different people were made to police on Sunday morning.

Police identified Ross as one of the people involved in the fight through body worn cameras and CCTV footage.

Police prosecutor Sergeant Rachel Todd said Ross was preventing police from doing their job.

“She was yelling and screaming at police and other members involved in the fight,” Sgt Rachel Todd said.

“She was telling police to f--k off.

“She was calling people c--ts and other profanities which continued.”

In relation to her earlier public nuisance offence, the court heard Ross was involved in an altercation outside of the same venue on July 3.

Sgt Todd said a verbal fight between two men started outside the pub about 2am and patrons leaving the venue, which included Ross, became involved.

The court heard the fight escalated into a fully-fledged brawl involving a large group of people.

“During this time (Ross) has engaged in physical altercations with other people,” Sgt Todd said.

“(Ross) was seen in multiple physical altercations with many people, pushing male and female people to the ground, yelling and screaming profanities, and otherwise was in the middle of the brawl. And not leaving when she was directed to.

“Police had to intervene as did multiple other people.”

The court heard Ross had similar offending on her record from 2015.

An application for a banning order was made.

Defence lawyer Brendan Gimbert told the court Ross, who was employed full time as an aged care worker, instructed she was trying to help people involved in the fights, not hurt them.

“(She was) pushing people away to break up some of the fights that were occurring,” Mr Gimbert said.

“Pushing people not to start fights of her own but to separate the friends and family members.”

Magistrate Rosemary gilbert told the court that Ross has three previous public nuisance offences and one of affray.

“You are 25, Ms Ross,” Ms Gilbert said.

“You are on the cusp of being considered by the court a person mature enough to bear the consequences of your own actions.

“You don’t have the benefit of what we call youth, when you get past 25.”

Ross was given an 18 month probation period and she is banned from all licensed venues on Clermont St in Emerald for six months.

No conviction was recorded.
