A Central Queensland man has narrowly avoided a stint behind bars after he unleashed a vicious attack on a teenager he says sledged his mum at a party that was later raided by police.

A Blackwater man has narrowly avoided a stint behind bars after he exploded in a rage and punched a teenager he said called his mother an “old s--t”.

Jason Roy George Stuart attacked the teenager days after hearing him sledge Stuart’s mother.

Police prosecutor Tasman Murphy said the 51-year-old punched and slapped the younger man on April 3, days after the comments were made at a party police raided.

The court was told Stuart said, “So, you’re going to call my Mum a s--t?”, with the victim responding he wouldn’t say that about anyone’s mother.

Stuart then punched the teenager in the face, loosening a tooth in his mouth and causing him pain.

The court was told pushed Stuart away to defend himself but Stuart allegedly slapped the teenager’s shoulder.

The teen was treated for his injury at Blackwater Hospital.

When police officers questioned Stuart, he admitted punching his victim but denied slapping him.

Mr Murphy said Stuart was on probation for an earlier assault at the time and recommended he be sentenced to jail.

Defence lawyer Danielle Lynas Torr said Stuart had moved from Rockhampton to Blackwater to care for his mother.

Ms Torr said her client previously worked in the mining industry but was unemployed after a work accident.

Magistrate Rosemary Gilbert told the court it was understandable to be offended by slurs against loved ones but said the reaction was inappropriate.

“The fact remains, you being the older man (and) this being an 18-year-old, you have exacted your reprisal when you should have been far more measured,” Ms Gilbert said.

Stuart pleaded guilty to assault occasioning bodily harm and was sentenced to four months’ jail, wholly suspended for 18 months.
