Emerald court: Elijah Santana Ngamane Hoff and Brian James Hicks caught drink driving

Two Central Queensland men were charged with drink driving offences in December 2022.

Elijah Santana Ngamane Hoff and Brian James Hicks both appeared in Emerald Magistrates Court in January for separate drink driving offences in Emerald.

Both men entered guilty pleas and had no legal representation.

Police Prosecutor Tasman Murphy told the court that at 12.52am on December 3, police saw a Nissan Pulsar driving along Clermont Street.

The vehicle appeared to accelerate, turned onto Anakie Street, and then back along Clermont Street.

When the vehicle eventually stopped and the driver’s door was opened by police, Hoff was reclined and laying back with the keys in the ignition.

A male passenger got out of the car when it stopped for the police.

Hoff, 34, told police he had consumed two Guinness, six schooners of Great Northern, and a scotch and coke between 7.30 pm and 12.15am.

At 1.15am he recorded a BAC of .106.

Hoff contested that he increased his speed and told the court the police officer who intercepted his vehicle should have made it clearer to him that they wanted him to pull over sooner.

Hoff was convicted and fined $550 and is disqualified from driving for three months.

A conviction was recorded.

Brian James Hicks

Mr Murphy said police on patrol at 11.45pm on December 2 saw a Nissan Navara travelling along Retro Street, Emerald, and then made a u-turn onto Ruby Street where the car stopped for police.

There were three male passengers in the car.

Hicks, 29, told police he had three rums and cola, four or five stubbies of Hahn 3.5, and a mouthful of rum between 5pm and 11.30pm and was dropping a friend off to their home.

He blew a reading of .055.

Hicks, who works full-time, has a partner and three children.

He was convicted and fined $400 and disqualified from driving for a month.

A conviction was recorded.
