Peta Evelyn Schmidt in court for assault, burglary and theft

A young mum has avoided time in jail after breaking into her former partner’s home and trying to punch him in the testes.

A young mum has avoided time in jail after she broke into the home of her ex-partner then assaulted and robbed him.

Peta Evelyn Schmidt, 36, pleaded guilty to stealing, assault occasioning bodily harm while armed and in company and burglary in company, all in a domestic violence setting, when she faced Bundaberg District Court on May 29, 2023.

The court heard Schmidt had ended a “tumultuous” and “reciprocally domestic violent” relationship when she and two co-accused went to her ex-partner’s home to retrieve belongings.

The mother of one reportedly went to the home on October 20, 2021, after she had spoken to police who advised her they would collect her belongings for her if required.

The court heard the situation “quickly spiralled” when her co-accused, Jason Thomas Boyd, allegedly began punching Schmidt's ex-partner in the face after he opened the door.

It was reported the second co-accused, Amber Maree Joyce, allegedly grabbed a metal pole which was in the entryway for “further violence”.

Schmidt then “joined” her co-accused and grabbed the legs of her victim, twisting his foot, biting his toe and attempting to punch him in the testicles.

The court heard the victim suffered multiple abrasions and Schmidt initially denied any wrongdoing.

During the altercation Boyd allegedly grabbed a TV and walked out of the house. The victim’s car keys, bank card and about $70 cash were also taken.

Judge Terry Gardiner considered the minor criminal history Schmidt had and her consistent employment in a range of fields, including as a butcher and aged care nursing assistant.

The court heard Schmidt was also battling an ongoing prescription medication addiction triggered by a back injury.

She was sentenced to 18 months jail for burglary, 12 months for assault and nine months for stealing.

All charges were to be served concurrently, parole was set for May 29, 2023 and convictions were recorded.

Boyd was arraigned on one count of burglary, one count of theft, and one count of occasioning bodily harm at the Bundaberg District Courthouse on May 29, 2023.

He plead not guilty to all charges, and the matter was listed for trial on August 21, 2023.

Joyce was also charged and the matters transferred to a Brisbane courthouse.
