Bayden Edward Byron found guilty of assault in Bundaberg court

A convicted child abuser previously punched a woman and attacked her with a piece of wood before reversing his car at her, Bundaberg Magistrates Court has heard.

Bayden Edward Byron pleaded guilty on Monday to common assault, driving without a licence and two counts of breaching bail.

He appeared by videolink from Maryborough Correctional Centre, where he is imprisoned for offences including indecent treatment of children under 16 and using a carriage service to procure a person under the age of 16 years for sexual activity.

Byron, 38, was sentenced to six months imprisonment for these offences by Bundaberg District Court in April.

Police documents tendered at his latest court appearance state that prior to his sentencing, Byron drove to a woman’s address, approached her while she was sitting in her car and began to verbally abuse her.

The woman pushed Byron away after he stepped close to her, causing her to fear for her safety.

Byron then “rushed forward” and punched the woman in her shoulder, causing “immediate pain”.

He then returned to his car and, while she was standing in front of her car, reversed backwards towards the woman causing her to think that she was going to be rammed between the two vehicles.

Byron then drove away, following which the woman drove to his home.

After verbally abusing the woman further, Byron moved his car to block the woman’s vehicle in his driveway so she could not leave his property.

He then picked up a piece of timber from his veranda and swung it with an intention to strike the woman’s car window, but was moved away by another person at the scene.

In police interviews Byron denied punching the woman, and said that she could have left his property via the back gate after he blocked the driveway.

Bryon’s lawyer told the court that he was born with cerebral palsy, and when a child was regularly subjected to physical violence by his father who was a violent alcoholic.

The court heard Byron was a father of four children.

In sentencing, Magistrate John McInnes told Byron he didn’t wish to complicate the sentence handed down by the District Court.

“The District Court has given you orders which involve a significant level of punishment and also significant opportunities for rehabilitation,” Mr McInnes said.

“And it seems to me, I don’t need to complicate those arrangements.”
