The case against a man who was allegedly involved in a standoff with Toowoomba police where a firearm was discharged has had his matter mentioned in court.
On Wednesday, December 21, a large number of Queensland Police Service personnel rushed to a Park St apartment where two men, Morgan Mundey and Peter Gibbs, were allegedly holed up.
Police allege Mr Mundey was armed and fired shots, however Mr Gibbs was not charged with anything in relation to the incident.
Morgan Western Troy Mundey’s lawyer Brad Skuse told the Toowoomba Magistrates Court on Friday, February 10, that he was waiting for police to hand over all their evidence.
Mr Skuse said his client had been charged with an indictable offence, using a projectile to cause grievous bodily harm (acts intended), however he only received a partial brief of evidence from the prosecution.
Police prosecutor Bettina Trenear said a large number of shell casings from the scene had to be analysed and noted ballistic reports took time to complete.
Ms Trenear said the other missing evidence related to outstanding statements from the large number of officers who were called to the incident late last year.
The 44-year-old Sunshine Coast man was facing more than 30 alleged crimes, however Mr Skuse said a number of his charges were unrelated to the Newtown incident.
Magistrate Clare Kelly formally ordered the full brief of evidence to be completed by March 17, but said she understood the ballistics report may take longer.
The case will next be mentioned on April 7.
Mr Mundy has been charged with the following offences; acts intended (projectile) to cause grievous bodily harm, fraud, entering a premises and committing an indictable offence, possessing tainted property, possessing suspected tainted property (jewellery) and failure to appear in accordance with an undertaking.
Mr Gibbs, who was in the Newtown home at the time, was charged with the following offences; entering a premises or dwelling, receiving tainted property, unlawful use of a motor vehicle, stealing, and unlicensed driving.
Peter Mark Gibbs, 35, was remanded in custody after a failed bid for bail in relation to other charges.
