Former chief justice dismisses threat of ‘judicial activism’ to Voice

Former High Court chief justice Robert French has rejected talk that “activist judges” could expand the power of the Indigenous Voice to parliament as “a shadow which distracts from the substantive debate” about its merits.

Mr French told a constitutional conference last Friday that a climate change case brought by student activists had outlined important principles around “the limits of the judicial function” that were relevant to the Voice.
