Merger crackdown to make ACCC ‘judge and jury’ on deals
More mergers and acquisitions will be able to be blocked under federal government laws that give the competition watchdog stronger discretionary powers than previously thought, lawyers representing big business say.
Draft laws released by Treasury last week propose expanding the test for assessing a substantial lessening of competition, not just for mergers, but for all provisions in the competition law which adopt that central test.
