A man will be able to continue caring for disabled wife after he avoided jail for being caught with dozens of serious child exploitation videos.
Giulio Pederiva, 57, was sentenced in the Adelaide District Court this week after his “shocked curiosity” led to him committing abhorrent crimes.
Pederiva’s West Croydon house was searched on November 12, 2019.
Four images and 53 videos of child exploitation material were found, with 20 videos aggravated by the children depicted being under the age of 14 years old.
The court heard the majority of the videos were classified as Category 4, with the remaining classified as Category 3 or 5.
Category 5 on the Oliver scale – which forms the basis on which child exploitation images and videos are graded – is where a child is subjected to sadism, torture, bestiality or humiliation.
The court heard Pederiva had created an online profile where he engaged in role playing to feed his “deviant fantasies”.
“You increased your sexual fantasy and role-playing behaviour and began to use file sharing programs to search directly for material based on the ‘Daddy/boy’ script,” Judge Jane Schammer said during sentencing.
“You admitted to having watched pre-pubescent child exploitation material and bestiality material at times, but denied any specific arousal from this material, instead describing your interest as being in the form of ‘shocked curiosity’ and a sense of extreme taboo.”
Pederiva, of West Croydon, had previously pleaded guilty to possessing child exploitation material.
The court heard Pederiva had been employed as an Italian relief teacher since about 2012.
“A few weeks after being charged with this offending you were deregistered by the Teaching Board and you have been unemployed since then,” Judge Schammer said.
The court heard Pederiva’s wife has multiple sclerosis and Pederiva is now her full-time carer.
“Your wife was shocked and horrified by your conduct, but remains supportive of you,” Judge Schammer said.
“Your offending occurred in the context of family challenges … and in particular your wife’s declining health and worsening disabilities, which led to a corresponding decline in your level of intimacy as a couple.”
The court heard Pederiva is ashamed and remorseful for his offending and is at low risk of reoffending.
Judge Schammer sentenced Pederiva to two years jail, with a non-parole period of 14 months.
“I am mindful of the important role you play as the sole carer for your wife and the resulting hardship which your family will suffer in the event you are imprisoned,” she said.
The sentence was suspended on a three year good behaviour bond for $500, with supervision.
