Tiser Explains: How a criminal trial works

Fallen cafe identity and convicted teen sex predator Miguel Dantas De Sa has been found guilty of sexually assaulting a second employee – on her very first day at work.

Late on Monday, a District Court jury found the once-renowned Rundle Street restaurateur guilty of two counts of rape.

Jurors ruled that, under the guise of teaching his newest employee how to serve alcohol, De Sa plied the 18-year-old with liquor for four hours, then took her to bars after her shift.

They further ruled he raped her while she was intoxicated, then sent her home to her parents in an Uber with a text message claiming she had “got quite drunk at work training”.

De Sa’s crimes, committed just months before he was convicted of sexually assaulting another employee, 16, will see his existing 2 ½ year prison term extended.

They all but guarantee the Portuguese immigrant will be deported for failing the character test – as will his family, who live in Australia under his working visa.

At trial, prosecutors alleged De Sa, 30, of Nailsworth, had invited the victim to work for him after she applied for a job via social media.

“She found De Sa a bit flirtatious … he commented about how pretty she was and suggested she should work out the front to get customers in,” they said.

“Her first shift primarily involved learning how to pour beers and mix various drinks … De Sa asked her to try some of the drinks … she began to feel extremely intoxicated.”

They alleged that, after going to several bars with De Sa after work, the victim had “significant blanks” in her memory.

She recalled him standing “naked from the waist down” in front of her “in a bedroom she did not recognise”, being forced to perform a sex act and then “vomiting”.

They said De Sa called an Uber to take the victim to her parents’ home, then sent an SMS to her phone.

“Are you okay darling? Please let me know when you get home safe, you got quite drunk at work training, I had to call you an Uber,” the message read.

Counsel for De Sa argued the victim’s evidence had too many “gaps” that she had “filled up” and “come to believe”, saying her account was “too inconsistent” to be accepted.

Jurors disagreed and found De Sa guilty of both counts – he was remanded in custody for sentencing submissions at a later date.
