Tristan Mourant pleaded not guilty to causing death by dangerous driving after Elizabeth crash

A driver will stand trial accused of killing a woman after a collision he was allegedly involved in sent the other car into a tree where it burst into flames.

The driver allegedly responsible for the fiery crash that killed a northern suburbs woman and injured another will stand trial.

Tristan Craig Mourant, 52, pleaded not guilty in the Adelaide Magistrates Court on Wednesday to causing death by dangerous driving, causing harm by dangerous driving and driving without due care – all aggravated offences.

Police previously reported the crash occurred on January 21 at the intersection of Main North Rd and Fletcher Rd at Elizabeth when a Toyota van and BMW collided just after 7pm.

They alleged the collision caused the van to crash into a nearby tree on the median strip before bursting into flames.

Sadly, the passenger in the van, a 47-year-old woman from Blair Athol, died at the scene.

The driver of the van, a 56-year-old Blair Athol man managed to escape the vehicle and was taken to the Royal Adelaide Hospital with serious injuries.

Under SA law, death by dangerous driving can only be downgraded to an aggravated count of driving without due care.

Instead of facing a maximum 15-year prison term and mandatory minimum 10-year licence disqualification if convicted, offenders face a maximum sentence of 12 months’ jail and a six-month licence disqualification.

If found guilty, an aggravated charge of death by dangerous driving can carry a term of life imprisonment, while an aggravated charge of causing harm in the same manner can carry a seven-year sentence.

In the Adelaide Magistrates Court on Wednesday, Magistrate Simon Smart committed Mr Mourant, of Munno Para, to the District Court for arraignment in January.
