A man was allegedly held hostage for hours and subjected to humiliating acts by a trio, before being forced to withdraw $37,000.

Kamran Misaghisaisan, 37, was jailed for his role as the ringleader in kidnapping and blackmailing the man after becoming aware of his savings.

During Misaghisaisan’s sentencing, the District Court heard the victim lived with his co-accused in Parafield Gardens.

The victim was at home on June 15, 2021 when he came across Misaghisaisan holding a tomahawk.

The court heard Misaghisaisan, who had a dispute with the victim over drugs, swung the tomahawk at the victim and struck him on the hand.

Misaghisaisan followed the victim into his room where he directed him to take his pants off and then cut the victim’s boxer shorts with the tomahawk.

“You also threatened the victim and threatened harm to his children and threatened to harm the victim’s dog,” Judge Michael Burnett said during sentencing.

The court heard at one point Misaghisaisan held a deodorant can towards the victim and placed a lighter in front of it and lit the flame.

He also bound the victim’s legs using a belt and coloured the victim’s finger and forced him to fingerprint a false confession.

“You also collected some woman’s clothing and forced the victim to shove that clothing down his boxer shorts,” Judge Burnett said.

The court heard Misaghisaisan gave one of his co-accused the tomahawk and told him to hit the victim if he tried to move.

The victim was then forced into a car with the trio and driven to a bank, the court heard.

The victim asked to withdraw $37,000 at the bank but fortunately quick thinking staff called police.

Samantha Emily Eatts, 31, of West Richmond, and Mathew John Humphrys, 31, of Parafield Gardens, have pleaded not guilty to their charges and will face trial next year.

During his victim impact statement, the court heard the victim, who suffered cuts to his body, now leads a lonely and solitary life because of the offending.

The court heard Misaghisaisan came to Australia from Iran as a refugee in 2009.

He began working as a security guard, where he was “introduced to and embraced” cocaine and methamphetamine.

The court heard Misaghisaisan, who had written an apology letter to the victim, committed the offending to support his methamphetamine addiction.

Judge Burnett said the kidnapping was terrifying for the victim and caused him considerable distress and humiliation.

He sentenced Misaghisaisan to five years and six months jail, with a non-parole period of three years.

The sentence was backdated to June 15, 2021.
