A mother-of-two who hid a gun in her garage only months after an alleged terrifying daylight shooting said it's not her on the CCTV footage, a court heard.
Donna Maree Sell, 37, is at risk of losing her housing as she remains in custody for hiding a rifle and bullets in a crafty hiding spot.
Police attended Sell’s Smithfield home on July 25, last year after receiving information she was in possession of a firearm and allegedly trafficking drugs.
They conducted a search of the premises and found a firearm in the garage which had been concealed inside a pillow case that had been pushed into a PVC pipe.
Ammunition was also found in the pillow case.
Sell pleaded guilty to possessing the firearm.
During sentencing submissions, the District Court heard Sell was on home detention bail for charges of affray and discharging a firearm when she was arrested on the new offence.
She has pleaded not guilty to those charges and will face trial in February, next year.
A brawl allegedly erupted between two feuding groups on January 21, last year.
Police allege some of the group reattended the Elizabeth Vale house shortly after they left.
“It’s alleged that Ms Sell discharged the firearm at that property,” Joanne Liptak, for the prosecution, said.
David Moen, for Sell, said his client was seen on CCTV throwing a can at a person during the affray - but it didn't hit him.
"That's the only action that she has in the affray ... she is verbally assaulted by the individual she throws a can at," he said.
Mr Moen told the court there were identification issues with the CCTV of the alleged shooting as the footage was grainy.
"She cannot be seen holding a firearm or item in her hands at any time, nor can she be seen discharging an item at the time of the CCTV footage," he said.
"There are other people who have pleaded guilty who did have possession of a firearm at the time and discharged that at various locations."
A daylight shootout between speeding cars on heavily populated Main North Rd allegedly followed – which Ms Sell isn’t charged with.
“Both cars ended up shooting at each other, so it was like a Bonnie and Clyde chase if I can put it that way between two cars,” Mr Moen said.
Mr Moen said Sell was at risk of losing her long term accommodation if she remained in custody.
“It was suggested that Ms Sell was trafficking methamphetamine from her address, there is no evidence of that at all,” he said.
Ms Liptak asked for time to cross examine Sell on the reason she had the firearm.
The charge was adjourned until next month.
