A man who violently attacked the mother of his child after a funeral, including headbutting and slamming her head into a door may be home in time for Christmas.

A Whyalla father who bashed his partner after a funeral had a long time to think about his actions while in custody.

Nathan Edward Werth, 34, is eligible for parole for his vicious assault on his partner who had only recently given birth to their daughter.

The Adelaide District Court heard that the victim was Werth’s partner.

Werth and the victim attended a family funeral on September 24, 2020.

“You got into a disagreement with one of the family members of the complainant that led to a physical altercation,” Judge Paul Slattery said during sentencing.

Werth left the funeral early.

“Sometime after she (the victim) entered the home you commenced yelling at her and blamed her for the earlier disagreement you had with one of her family members,” Judge Slattery said.

“In the course of that argument you got into the face of the complainant and headbutted her.”

The court heard Werth then hit the victim multiple times to the face, before pushing her head into a door.

“To get away from you the complainant locked herself in the toilet and after a time you left the premises,” Judge Slattery said.

“Police attended and observed the complainant to be visibly upset and shaken.”

The victim was hospitalised and suffered significant injuries to her nose, extensive swelling, soreness and a bump on the back of her head.

Werth, of Whyalla Norrie, had previously pleaded guilty to three counts of assault.

The court heard Werth has previously worked as a truck driver and has potential work in scaffolding available upon his release.

“You are still a young man and you have your whole life ahead of you,” Judge Slattery said.

“You realise that you need professional assistance with anger management and drug relapse prevention.”

The court heard the victim, who shares a one-year-old daughter with Werth, has suffered ongoing mental distress from the assault.

“You have had time to reflect upon your behaviour, to mature as a human being and as a man and to understand that this type of behaviour is completely wrong because it is so unacceptable,” Judge Slattery said.

“You plainly have difficulties with self-control.”

Judge Slattery sentenced Werth to 21 months jail, with a non-parole period of 11 months.

The sentence was backdated to September 25, 2020 when Werth was taken into custody, meaning he is now eligible for parole.

“Mr Werth, I fervently hope that you will be home for Christmas,” Judge Slattery said.

“I also more fervently hope that you have matured as a man … that you would have a family Christmas free from violence, free from drugs, free from alcohol and that you would behave as a man of your age.”
