Kyle William Dicker guilty of attacking former partner in Mount Gambier home

A “heavily intoxicated” supermarket manager broke into his ex-partner’s room, threatening her, saying she was lucky she was the mother of their child, after a big day fishing.

A supermarket manager was so intoxicated he barely remembers attacking his sleeping former partner.

Kyle William Dicker pleaded guilty to aggravated assault at the Mount Gambier Magistrates Court on Tuesday.

He and his victim were in a domestic relationship between 2015 and 2018 but remained living together to co-parent their son.

The police prosecutor said the victim was in fear as Dicker stood over her and yelled “I could kill you right now if I wanted to” on April 8.

“The victim was asleep in her bedroom when the defendant forcibly entered her room, causing her to wake,” she said.

“He began yelling at her before grabbing the bed frame and lifting it causing her to fall to the ground.

“He stated ‘you’re lucky that your (child’s name’s) mother but that luck will run out’.”

Dicker had previously been convicted for aggravated assault with a weapon in 2010, the court heard.

The victim dialled triple-0 and Dicker was arrested, spending 4 hours in custody where he blew .222 when breath tested.

Dicker’s lawyer Ebony Cunningham said he had been fishing and drinking all day and had discovered money missing from his account.

He believed his former partner had been gaslighting him for a period of time about using his card to make purchases.

“He described himself as certainly heavily intoxicated,” she said.

“He became enraged … due to his level of intoxication he actually has little recollection of the incident.”

Ms Cunningham said Dicker, who works in a managerial position at Coles, was genuinely remorseful, ashamed of his actions and unlikely to reoffend.

She said he had given up alcohol for 12 months before the offending and hasn’t had another drink since.

“He concedes as a younger man he was a hothead and has a tendency to drink,” she said.

“He has worked hard over the last few years to move beyond that person.

“He is acutely aware of the consequences of the offending, he also hasn’t seen his son since.”

Magistrate Maria Panagiotidis was satisfied Dicker was unlikely to reoffend.

She recorded a conviction and ordered him to serve a nine month good behaviour bond at $1500 plus pay court fees.
