44-year-old Murray Bridge man denied bail, charged with domestic violence and rape

A man will remain in custody for allegedly forcing his partner to perform sex acts on her uncle before sexually assaulting her with an ice pipe.

The 44-year-old man, who cannot be named to protect the identity of his alleged victim, was denied bail in the Adelaide Magistrates Court last month, charged with disturbing rape allegations.

A prosecutor previously told the court they were opposed to all forms of bail, for the safety of the alleged victim – who was in fear of her partner’s controlling and violent behaviours.

The court heard the alleged victim was the man’s partner at the time of the alleged offences in April at Murray Bridge.

“She was forced to perform fellatio on (the second man), who was her uncle … and she was forced to do so by the defendant,” the prosecutor said.

“She was forced to do so arising from a drug debt.”

The woman’s uncle, a 50-year-old Murray Bridge man, is charged with rape as a result of the alleged incident.

The prosecutor told the court the alleged victim told police her partner was involved in drug trafficking.

“An analysis of (CCTV footage seized from the house) is consistent with people attending the house and the defendant selling drugs,” the prosecutor said.

The prosecutor said the man also had a prior conviction for drug trafficking.

The court heard the woman was then allegedly raped multiple times by her partner on April 8.

The court heard an analysis of the first man’s phone revealed private photos of the alleged victim taken without her consent.

The prosecutor said the man allegedly burnt the woman on the forehead with a cigarette on another occasion.

The Murray Bridge man is charged with multiple offences, including five counts of rape and assault causing harm.

He has pleaded not guilty to the charges.

James Noblet, for the man, said the nature of the allegations was unusual and the woman had significant mental health issues.

“The co-accused is supposed to have owed a debt to the applicant but then the complainant was supposed to be providing some sort of forced sexual service on the co-accused because of that debt,” he said.

“That seems like an odd narrative.”

The court heard the alleged victim said she was affected by the drugs during the course of the relationship.

Magistrate Michelle Sutcliffe denied the man home detention bail last month and adjourned the charges to the District Court for arraignment in March.
