The man accused of stabbing a topless waiter said it can’t have been him as he chooses to handle his anger by breaking out into song and dance.

The man accused of stabbing a topless waiter at a 60th birthday party has given bizarre evidence in his own defence, slamming the courtroom as a joke.

On Thursday afternoon, Abdul Kadws Mohammed Amin told the jury he was not responsible for stabbing then topless waiter Paddy Colliar in August 2021.

In his opening address on Monday morning, Matt DeLorme, prosecuting, told the jury that Mr Colliar had been employed as a topless waiter on the evening when the incident occurred.

“He was engaged to attend a 60th birthday party at a business called Pole-4-Fitness that was located in Para Hills West,” Mr DeLorme said.

The court heard Mr Colliar was having a conversation with a female at the party before “an angry” Mr Amin “grabbed (the woman) by the throat and began thrashing her from side to side”.

Giving evidence on Tuesday morning, Mr Colliar told the jury that he had “intervened” after seeing Mr Amin thrashing the woman around “like a ragdoll”.

“It was in the moment, but I felt a thump to my ribcage,” he said.

He said it wasn’t until a young girl at the party said he’d been stabbed that he noticed the blood “pouring” out of him.

Mr Amin, now 26, is currently standing trial in the District Court charged with one count of aggravated causing harm with intent. He has pleaded not guilty.

However, giving evidence on Wednesday, Mr Amin told the court he was having a calm conversation with his girlfriend’s sister before Mr Colliar “assaulted him”.

“It was insanity,” he said.

“I can’t believe that I’m being charged (and) I’m in jail for this. This is horrendous.

“This is ridiculous, this courtroom is a joke.”

He referred to Mr Colliar as a “weirdo,” and “horrendous person” with “beady eyes”.

When asked what he would have done if his uncles hadn’t held him back after Mr Colliar intervened he replied: “When I’m in a furious state emotionally I get through my trauma through song and dance so I would probably broken out in some form of Bollywood star”.

Mr Amin was then asked if he stabbed Mr Colliar which he vehemently denied.

“I did not stab Paddy Colliar … but apparently I did in the back while being assaulted and grabbed,” he replied.

“I somehow go-go gadgeted my arms.”

Mr Amin told the court his knife used in the alleged attack was his but he didn’t get it back after it was used to cut the birthday cake.

‘He assaulted me’: Alleged topless waiter stabber takes the stand

The man accused of stabbing a topless waiter at a 60th birthday party in a pole dancing studio has told a court that he had seen the assault weapon that night – but only when it was cutting a cake.

Giving evidence in his own defence on Wednesday afternoon, Abdul Kadws Mohammed Amin told the jury he was not responsible for stabbing then topless waiter Paddy Colliar in August 2021.

During examination by his defence lawyer Aaron Fornarino, Mr Amin said he had arrived at the pole dancing clinic at about 11pm on the evening of August 7, 2021.

He said that he’d seen Mr Colliar arrive in an Uber, and told him to leave.

“We’re mostly Greek and Arab. He was Anglo-Saxon,” Mr Amin said.

“I didn’t think he was coming to our party. The girls probably planned it. They probably thought I would object to the idea.”

Mr Amin, now 26, is currently standing trial in the District Court charged with one count of aggravated causing harm with intent. He has pleaded not guilty.

Earlier on Wednesday, Matt DeLorme, prosecuting, showed the jury the alleged weapon used to stab Mr Colliar – a foldable knife which, once unfolded, measured about 19cm long.

Mr Colliar then identified the knife as the weapon used to stab him in the back after a domestic altercation which, he said, he tried to intervene in.

Mr Amin, however, told the court that the knife was used in a completely different way to what prosecutors allege.

Mr Fornarino asked Mr Amin if there was a birthday cake at the event, to which he replied: “of course, what type of birthday party doesn’t have a cake?”

“Have you seen that knife before?” Mr Fornarino asked.

“Yes. It was used to cut the cake,” Mr Amin replied.

During cross examination by Mr DeLorme, Mr Amin said that he had a brief interaction with another woman at the party – the sister of his then girlfriend – and that Mr Colliar then “assaulted him” for no reason.

“We (the woman) and I have a close relationship. I’ve known this family for 15 years. They’re not strangers, I’ve known them since I was little. That’s when Colliar intervened. I don’t know why. The family was all present,” Mr Amin said.

“It was my missus’ sister. There were 30 people there. I didn’t go to shake my missus’ sister in front of all of them. That’s a death wish.

“Colliar attacked me. We were all in shock.

“He went on the news saying he was saving a woman from a domestic violence situation. I lost my job at the time. I actually had upskilled to be in cyber security at that time and I got fired after putting myself through uni, through everything and he’s just pulled my face through the rubble. Everyone was just shocked and disgraced.

“He assaulted me, I didn’t assault him, and now I’m standing court for it. It’s horrendous.”
