Topless waiter Paddy Colliar gives evidence in 60th birthday stabbing trial

A man working as a topless waiter at a birthday event in a pole dancing venue has told a courtroom of the “fountain of blood” he saw pouring out of his ribcage when he was allegedly stabbed at the party.

In the South Australian District Court on Tuesday, Patrick “Paddy” Colliar told the jury he had identified Abdul Kadws Mohammed Amin as the man who attacked him at a birthday party, leaving him in hospital with 10 stitches.

Mr Amin pleaded not guilty in 2022 to the aggravated charge of causing harm with intent, arising from an alleged altercation in August, 2021.

In his opening address on Monday morning, Matt DeLorme, prosecuting, told the jury that Mr Colliar had been employed as a topless waiter on the evening of August 7, 2021 when the incident occurred.

“He was engaged to attend a 60th birthday party at a business called Pole-4-Fitness that was located in Para Hills West,” Mr DeLorme said.

“His role that night included pouring and handing out drinks, mingling in the crowd and trying to generally improve the atmosphere.

“Shortly before 1.30am, Mr Colliar was having a conversation with a female at that party. While he was talking to her, the accused, on the prosecution case, charged out of a door across the room – he was angry. A confrontation that followed between the accused and (the woman).

“As a result, the accused grabbed (the woman) by the throat and began thrashing her from side to side.”

Giving evidence on Tuesday morning, Mr Colliar told the jury that he had “intervened” after seeing Mr Amin thrashing the woman around “like a ragdoll”.

“He was very, very aggressive,” Mr Colliar said.

“The adrenaline, it was in the moment, but I felt a thump to my ribcage.”

He said it wasn’t until a young girl at the party said he’d been stabbed that he noticed the blood “pouring” out of him.

“I thought he’d just hit me. I didn’t think anything of it. I looked down and it was like someone turning on a tap. It was like a fountain, just pouring out blood,” he said.

The court heard that after the incident, Mr Amin was found sitting on the floor at a nearby On The Run service station where a worker there called for help. He was allegedly “so drunk he couldn’t walk, couldn’t stand by himself”.

Mr DeLorme said a knife was found at the scene, with both Mr Colliar and Mr Amin’s DNA found on it.

David Moen, for Mr Amin, told the jury they needed to question the identification of his client as the man who stabbed Mr Colliar.

“The defence case is that it was not Mr Amin who stabbed Mr Colliar,” Mr Moen said.

“If you come to the view that it was Mr Amin, you then need to go on to consider his intoxicated state at the time.”
