Crows Nest man Daniel Proud, 18, seeks bail on grievous bodily harm, assault
A father was left with serious facial fractures after a young man allegedly came to his Crows Nest home armed with a golf club.
An 18-year-old accused of a brutal assault in a Crows Nest home has pleaded for release on bail.
Prosecution alleged the 18-year-old part-time lifeguard went to a Crows Nest home on Tuesday night armed with a golf club and in company with another person.
They further alleged in court documents that Mr Proud assaulted a young woman at the property and attacked a 60-year-old father, leaving him with a fractured jaw.
Police claim an 18-year-old resident of the home fought off Mr Proud and inflicted minor stab wounds to the man’s back.
Duty lawyer Chelsea Saldumbide said Mr Proud denied any involvement in the alleged assault of the 60-year-old father, although accepted he was present at the home on that night.
She told the court Mr Proud was previously a very close friend of two of the occupants but had recently fallen out with the pair.
“That relationship began about two months ago and there has been an ongoing barrage from both sets of parties of abuse and threats,” she said.
“My client has provided his mobile phone to police which he informs me will confirm his instructions (regarding) the threats he received in the lead-up to this particular incident, but of course that phone is yet to be downloaded and those messages are not before the court.”
Ms Saldumbide suggested a ban on entering Crows Nest and nearing the alleged victim’s premises would ameliorate any risk to the alleged victims, arguing there was little risk to the wider community.
“In my submission, while these offences and these allegations are very serious … in terms of his general risk to the community, it is perhaps not a great risk balanced against his (short) criminal history.
Magistrate Michelle Dooley denied bail, citing a serious concern for the safety of the victims and a risk of reoffending.
“My grave concern here is that this appears to be some sort of ongoing feud,” she said.
“If I look at this purely on what is (alleged) before me, this is a young man affected by alcohol, armed with a golf club who has attended at this property and the subsequent events have occurred.
“There seems to be strong evidence that has been put before the court.
“I’m very concerned with the welfare of the (alleged victim).”
In response to her ruling, Mr Proud stated over the watch-house video link he “didn’t have any cuffs” on his hands and had hurt no one.
He was charged with common assault, grievous bodily harm, entering a dwelling with intent, assault occasioning bodily harm and stealing.
He will be remanded in custody awaiting his next court appearance on March 6, 2025.
