Townsville: Laura Rose Peverill (Black) fronts court over hot-car death of Rylee-Rose Black

Clues have been revealed about the approach that will be taken to prosecute the Townsville mother of a toddler who was found unresponsive in a hot car.

More clues have been revealed regarding the approach that will be taken to prosecute the guardians of a Townsville toddler who died in a hot car.

Rylee-Rose Black, 3, was rushed to hospital after she was found unresponsive inside her mother’s four-wheel drive parked in the driveway of a Burdell home on November 27, 2020.

Her mother Laura Rose Peverill (Black) and her boyfriend at the time Aaron Danyel Hill each face a single charge of manslaughter over the girl’s death.

Peverill’s matter was mentioned in the Townsville Supreme Court on Thursday.

Following the approval of a legal aid application, Legal Aid Queensland lawyer Abbey Huckstep confirmed that they had taken carriage of Peverill’s case.

Given that they were in the process of printing and collating a “very large” brief of evidence, she asked Justice David North for an adjournment until late November.

Mr North asked crown prosecutor Andrew Walklate what was happening with Peverill’s co-accused Hill and whether their matters would be trialled simultaneously or separately due to there being radically different allegations in terms of criminality or the circumstances.

The prosecutor replied saying the cases weren’t radically different and that “it’s the same case from the Crown’s perspective against both whether there’d be any application was another matter”.

Mr Walklate said Hill’s matters were still being processed through the court.

“Now I understand, and this is only from Mrs (Claire) Grant, who is representing that accused, that some of the things that occur in the magistrate’s court are with a view to testing the crown case. That may take a little while,” he said.

When Hill’s matter was last in the Townsville Magistrates Court on September 19, defence lawyer Claire Grant said “there was no evidence that (Hill) owed a duty of care to the child, such that he was criminally responsible for the death of the child”.

It was argued that Rylee-Rose’s father Peter Black should be allowed to be cross examined on a number of matters to obtain the full facts and establish if Hill had a duty of care and how it applied.

Magistrate Taylor said it would ultimately be a question of law as to what was a duty of care that would require the facts to be assessed during submissions.

Peverill’s case was adjourned until November 28 and Hill’s case will return on December 1.
