Jayden Michael Raedel, 21, has drug trafficking charges dismissed in Adelaide Magistrates Court

Multiple charges against a young man accused of drug dealing have been dismissed after a magistrate heard he would be in custody for more than a year.

A magistrate has dismissed multiple drug trafficking charges against a young man, calling a prosecutor’s request to have the case adjourned until July next year “completely unacceptable”.

Jayden Michael Raedel, 21, from Seacombe Gardens, appeared in the Adelaide Magistrates Court in front of Magistrate Simon Smart charged with two counts of trafficking a commercial quantity of a controlled drug, four counts of drug trafficking and four counts of possessing a prescription drug. He is yet to enter any pleas.

On Wednesday, the prosecution told the court they were seeking an eight-month adjournment to allow for the return of forensic science reports.

However, Mr Smart rejected the submission amid concerns Mr Raedel would be in custody for more than a year as a result.

“What that means is, this man spends a year in custody and at the end of that process, there may be no charges,” Mr Smart said.

“Either on home detention or in custody, no decision would have been made about charges for a year.

“It’s unacceptable that someone should remain in custody or on home detention for a year. It’s completely unacceptable.

“If a decision is made about what charges to proceed with, then the prosecution are enabled to recharge Mr Raedel. In the meantime, the charges are dismissed.”

Mr Raedel was arrested alongside his 19-year-old co-accused Shawnikwa Talisha Haines-Weetra after what police allege was the discovery of a commercial quantity of LSD, ecstasy, cannabis and prescription medication in July.

Police, with the Dog Operations Unit, attended and searched a Seacombe Gardens address where it is alleged officers found the drugs.

Mr Raedel was arrested and charged and did not apply for bail when he first appeared in the Christies Beach Magistrates Court in July.

On Wednesday, Mr Smart told the prosecution he was not prepared to grant an adjournment, and dismissed Mr Raedel’s charges.
