Alleged murderer Anastasia Marshall granted bail pending Supreme Court review

A woman who allegedly murdered her ex-wife before setting her body and home on fire is fighting for home detention bail, a court has heard.

A woman who allegedly murdered her ex-wife before setting her body and home on fire has been granted home detention bail, but won’t be leaving custody any time soon, a court has heard.

On Friday, Anastasia Marshall appeared in the Adelaide Magistrates Court via video link from the Women’s Prison in Northfield where she has been held since her arrest last month.

The 29-year-old has been charged over the death of her ex-partner Krystal Marshall, who was found dead inside her Aldinga Beach home following a house fire.

Ms Marshall is yet to formally enter pleas to one count each of murder, arson and destroying human remains to pervert the course of justice.

However, Nick Vadasz, for Ms Marshall, previously told the court his client “strongly denies” all allegations.

A 48-year-old male co-accused, who cannot be named for legal reasons and was living at the address, has also been charged, with police alleging that he and Anastasia both played a role in Krystal’s death after he was asked to leave the home.

Following a lengthy bail application period, Magistrate Kate White on Friday morning granted Ms Marshall home detention bail, but prosecutors said they would be seeking a review in the Supreme Court – meaning Ms Marshall will remain in custody until next week.

“I can indicate a Supreme Court review will be sought,” a police prosecutor said.

By law, prosecutors now have 72 hours to bring forward a review application in the Supreme Court, meaning Ms Marshall will remain in custody until Monday morning at the earliest.

Emergency services were called to a home on Barracoota Crescent in Aldinga Beach in October last year after a neighbour reported seeing smoke coming from the roof.

Fire crews extinguished the blaze and when they checked the home, they found Krystal’s body.

Days after the incident, Anastasia was seen at the home, telling reporters Krystal’s death was “sad”.

Outside court, Mr Vadasz told the media his client was “handling” being in custody, but that he didn’t think the prosecution’s case was particularly strong.

“Prosecutors are seeking a Supreme Court review, which means they have until Monday morning to get Ms Marshall back in court and then it will be up to a Supreme Court Justice as to what happens next,” he said.

“Today was a just decision and I’m hoping a Supreme Court Justice would see the same.

“She’s handling it as best she can.

“A charge of murder is a very serious allegation, and the evidence as I see it is weak. This is a weak case.”

Ms Marshall will return to court next week.
