Hobart Supreme Court: Man pleads not guilty to wounding another man with a zombie knife at a Rokeby unit in October 2017

A MAN accused of wounding another man using a “zombie knife” is arguing he acted in self defence.

Dallas John Eaves, 31, pleaded not guilty in the Supreme Court in Hobart to causing grievous bodily harm to Daniel Oswin in the early hours of October 19, 2017.

In her opening address to the jury on Tuesday Crown prosecutor Simone Wilson said Mr Oswin had previously argued with his partner and left to “cool down”.

Ms Wilson said when Mr Oswin returned to the Rokeby unit, Mr Eaves, a former boyfriend of his partner’s, was there.

Ms Wilson said Mr Eaves initially left Mr Oswin and his partner alone but then Mr Eaves came running towards Mr Oswin.

She said the two were wrestling and pushing and shoving each other.

The Crown alleges Mr Eaves wounded Mr Oswin by striking him to the head and body with a zombie knife — a knife with a multi-edged blade that the Crown has also described as a tomahawk.

Mr Eaves’s lawyer said the defence case was that Mr Oswin was the aggressor and placed Mr Eaves in a position whereby he had to act “in defence of himself and possibly in defence of another person who was present”, referring to Mr Oswin’s partner.

Ms Wilson said the jury would need to consider what the circumstances were that Mr Eaves found himself in, and whether his actions were reasonable.

The trial, before Justice Robert Pearce, continues.
