A man accused of intentionally shooting his brother at a remote NSW property with a .22 calibre rifle after a dispute is fighting attempts to undergo a forensic procedure to collect DNA.
Bradley Thorncroft, 20, appeared in Coffs Harbour Local Court on Tuesday where Magistrate Theresa Hamilton agreed to grant a hearing date after the court heard he was intending to contest the application.
The court heard Thorncroft will defend the attempts to obtain DNA samples, forcing prosecutors to argue their case before the magistrate at a hearing.
“The applicant will have to prove their application or justify it,” Ms Hamilton said.
In a separate development, Thorncroft’s mother Leisa Thorncroft successfully applied to have apprehended violence order conditions varied so she could visit her son while he remains in custody.
On November 11 in the same court, police prosecutor Kylie Banks said she was not opposed to the variation but flagged a constraint.
“The prosecution is not opposed while the defendant is in custody,” Ms Banks said.
Thorncroft has been behind bars since his arrest following the alleged shooting at a Nana Glen property on Orara Way just after 8.30pm on Saturday August 9.
Police will allege Thorncroft shot his older brother Brayden Thorncroft, 22, with a .22 calibre rifle following a dispute at the family home.
Paramedics rushed to the scene and treated the alleged victim before he was flown nearly 250km north to Gold Coast University Hospital for emergency surgery.
Within 30 minutes of the alleged shooting, police stopped an SUV on Carral Cl in Coffs Harbour and arrested Thorncroft.
Officers allegedly seized a rifle from the vehicle, which is undergoing forensic testing.
Thorncroft is charged with shooting with intent to murder; possessing and using an unauthorised firearm; possession of ammunition without a licence; stalking or intimidating with intent to cause physical harm; and mid-range drink driving.
A hearing date for the forensic procedure application is set for February 23.
