THE ice using self-described “king of the f***ing world” has been jailed for 18-months for robbing a Palmerston service station of six mobile phones in an apparent bid to return to prison.

Dwayne Ellis, 33, pleaded guilty in the Supreme Court to robbing the servo attendant by stealing the $1800 worth of phones in October last year.

The court heard Ellis entered the Puma service station on Chung Wah Tce at about 2.15am on October 26 before jumping over the counter and stuffing the phones into a plastic bag.

As he was doing so, he screamed at the attendant not to try to stop him and threatened to knock him out.

“No motherf***er’s going to stop me, you understand me? I’m the f***ing king of the f***ing world,” he told him.

“Don’t ring the police, I mean it, don’t ring the police, they know who I am, they’re going to look at my footage but I don’t give a f*** because this is my f***ing world.”

In sentencing, Justice Peter Barr said police had recognised Ellis on the shop’s CCTV footage as he predicted and he was arrested in Woodroffe a few days later.

Justice Barr said Ellis had had “significant substance misuse issues” since his teenage years and a long list of prior convictions, including for drug offences, aggravated assault and rape, for which he was released from prison in 2015.

“Based on a previous sentencing transcript, you struggled to adjust to living in the community after your release from prison in March 2015 and you felt overwhelmed at that time,” he said.

“You resumed use of alcohol and cannabis but also ice.”

Justice Barr said a presentence report prepared for the court indicated since then, Ellis had “engaged in a consistent cycle of offending”.

“It appears that substance misuse, unstable accommodation and difficulty coping with stress upon release to the community are major factors in your offending behaviour,” he said.

“You have spent most of your adult life in custody and there is a strong indication that you committed the relatively low-level robbery on 26 October last year in order to be returned to prison.”

In setting a non-parole period of 10 months, Justice Barr said while it would be “critical” for Ellis to do a stint in residential rehab, his criminal history meant he was unlikely to be accepted.
