Harley Barbaro girlfriend Hayley Webb acquitted of failing to follow police order to provide phone passcode

The girlfriend of Harley Barbaro has won a major court victory after being charged over an incident that occurred when police raided the alleged bikie’s home.

THE girlfriend of an alleged bikie was acquitted for not providing her phone passcode after a magistrate found police had no right to seize her mobile.

Hayley Webb, who is dating alleged Mongols bikie gang member Harley Barbaro, had her mobile phone seized when police raided Barbaro’s Ashmore home in February this year.

Ms Webb was staying at the home.

Police seized her phone and demanded she provide her passcode. She refused.

In July this year her barrister Marty Longhurst, instructed by Moloney MacCallum Abdelshahied Lawyers, argued that under the warrant to search Barbaro’s home there was no legal reasons for police to seize Ms Webb’s phone.

On Thursday, Magistrate Kerry Magee found Ms Webb not guilty.

The warrant for the search allowed police to seize property they suspected Barbaro might be using to supply cocaine, the court was told.

“The phone was used by his guest, Ms Webb,” she said.

“There is no evidence he exercised any degree of control over it.”

Magistrate Magee said because there was no evidence Barbaro had access to the phone, police should not have seized the device.

She denied an application for police to pay Ms Webb’s legal costs.

Outside court, Ms Webb’s solicitor Campbell MacCallum said: “Again and again police continually, flagrantly breach the law when exercising warrants.

“They are given a plethora of powers. All we ask is that they stay within those powers and let the courts wield power instead of grabbing what’s not theirs.”

Barbaro announced on Instagram this month that he and Ms Webb were expecting a child in March next year.

He is a member of the notorious family. His brother Pasquale Barbaro, an underworld boss, was shot execution-style in Sydney in 2016.
