A Geelong dad was murdered and his brother seriously injured in the fallout from a broken engagement, a court has heard.

It’s alleged Dylan Bond was fatally stabbed on April 26, 2021, while his brother Heath Bond was also seriously injured at the incident at a Thomson home.

Ashley Roy Feetham, of Werribee, is charged with murder, causing serious injury intentionally, and causing injury recklessly and is standing trial in the Supreme Court.

The court heard Heath was engaged to a woman named Abby Sexton.

But Ms Sexton developed a relationship with Mr Feetham and Ms Sexton and Heath called off their engagement.

Following their break-up, Heath and Ms Sexton had a conversation at a nightclub in the early hours of April 25, 2021.

Crown prosecutor Mark Gibson told the court Mr Feetham intervened and a physical altercation occurred between Mr Feetham and Heath.

On April 26, 2021, Mr Feetham messaged Dylan, as he had heard he was not happy with the altercation.

The messages quickly became heated.

The court heard Dylan and Heath went to an address in Thomson and arrived at the home about 3.14pm, where Mr Feetham’s mother and sister were out the front.

Dylan spoke to Mr Feetham’s sister while Heath went around the side and entered.

The Crown alleges Mr Feetham ran out of the lounge area, into the kitchen holding a kitchen knife and stabbed Heath in the stomach.

“After being stabbed, Heath stepped back and yelled ‘knife’,” Mr Gibson said.

Mr Gibson alleged Dylan made his way to the side of the house and noticed his brother hunched over.

It is alleged Mr Feetham swung a knife at Dylan, who soon collapsed.

The court heard Heath went outside and screamed for help, while Mr Feetham went to hospital for cuts he received on his hand.

The Crown believe Mr Feetham fatally stabbed Dylan in circumstances where he intended to kill him or cause serious injury, and stabbed Heath to cause him serious injury.

Mr Feetham’s barrister, Hayden Rattray, said over the course of the three week trial the jury will have to answer the question of who grabbed the knife first.

Mr Rattray asked the jury to consider why the two brothers were going to meet Mr Feetham and think about what their inventions could have been.

“The defence case is that Ashley Feetham was at all stages acting in self defence,” Mr Rattray said.

He told the court his client locked himself in the house, and when he saw the two brothers making their way to the home and believed they meant him harm.

Mr Rattray said Mr Feetham heard Dylan and Heath making threats before a two-on-one fight.

He said Dylan then armed himself with the kitchen knife.

“Mr Feetham, seeing that happen, lunged for the knife,” Mr Rattray said.

“On his account, he grasps the knife from the hand of Dylan Bond and badly injures three fingers on his left hand.”

“He comes into possession of a knife shortly after that, waving it around … and the fight stops, and Dylan Bond collapses.”

Crown Prosecutor Mark Gibson said Mr Feetham was arrested at the Geelong hospital at about 4.50pm.

In an interview with police, he said he, and the two men, rushed at each other and a scuffle ensued.

The court heard Mr Feetham provided a version of the event to police where he was acting in self-defence and said he did not know the man was Heath’s brother.

The trial continues.
