A TOOWOOMBA man released on parole for stealing a cement truck from a Harristown company yard has been returned to prison for an offence at the weekend.
Bradley James Walker had in November been jailed for 14 months, minus 93 days spent in pre-sentence custody, and released on parole after he pleaded guilty to taking the cement truck from a Neil Mansell Concrete holding yard in February.
The truck was later found bogged near Clifton with substantial damage.
The 23-year-old was taken back into custody on Saturday after police approached him at the BP Service Station on the corner of Ruthven and North Sts about 12.22pm, Toowoomba Magistrates Court heard.
On police questioning, Walker said he had a flick knife in the front of his trousers, which was soon confirmed, police prosecutor Sergeant Tim Hutton told the court.
He told police he had just acquired the knife from a friend’s place, Sgt Hutton said.
Walker appeared in court by video link from the Toowoomba watch house to plead guilty to possessing a knife in a public place.
As a result of the offence, his parole had been suspended and he was on a return to prison warrant, Sgt Hutton told the court.
Duty solicitor Brad Skuse, of David Burns Lawyers, told the court his client had co-operated with police and declared the knife and asked that his client be fined so as not to interfere with his current sentence.
His client still had nine months to serve on the original jail term, Mr Skuse said.
Acting Magistrate Roger Stark fined Walker $400 but ordered no time to pay with the time to be served out concurrently with his present sentence.
It would be up to the Parole Board as to whether Walker served out the remaining nine months of his sentence or that he was released after serving part of that time.
